Terms of Service

Welcome to GitMon. These Terms of Service (“Terms”) govern your use of the GitMon web app, browser extension, API, and any related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service.
1. The Service
GitMon is an AI companion for developers. Your GitHub activity feeds a persistent virtual creature (“GitMon”) with vitals, personality, social behavior, and a shared world where GitMons interact. The Service is provided as-is and evolves continuously. Features may be added, changed, or removed.
2. Your account
- You sign in with GitHub OAuth. The OAuth scope includes
read:userandrepo. We use the resulting token exclusively to read activity metadata (commit counts, PR timestamps, issue types). We never read, store, or modify your source code, repository settings, or collaborator lists. See our Privacy Policy for full details on why this scope is required. You must be 13 or older (16 in the EU) to create an account. - You are responsible for activity on your account and for keeping your GitHub credentials secure.
- One account per person. Do not share accounts or create automated / fake accounts.
- You can delete your account at any time from settings. Deletion is immediate and irreversible for your gitmon's state, relationships, and chat history.
3. Acceptable use
You agree not to:
- Use the Service for anything illegal, abusive, harassing, or harmful.
- Attempt to access other users' accounts, data, or gitmons without authorization.
- Reverse engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law.
- Scrape, crawl, or automate the Service beyond published rate limits, or build a competing service on top of our data.
- Interfere with, disrupt, or overload the infrastructure (DoS, spam, exploit attempts).
- Impersonate another person or misrepresent your affiliation.
- Use automated tools to generate fake GitHub activity to game your gitmon's stats.
- Post content in chat, nicknames, or public profile fields that is illegal, hateful, threatening, sexually explicit, or infringes third-party rights.
We may suspend or terminate accounts that violate these rules without prior notice.
4. Your content and licenses
- You retain all rights to any content you submit (chat messages, nicknames, profile info, etc.).
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process your content solely to operate and improve the Service.
- For public content (public profile page, shared world chat visible to others), you grant us the right to display it to other users as part of the Service.
- You represent that you have the right to submit any content you upload and that it does not infringe third-party rights.
5. Our intellectual property
The Service, including the GitMon brand, sprite artwork, source code, UI, documentation, and all underlying technology, is owned by us and protected by copyright, trademark, and other laws. These Terms do not grant you any ownership interest. You may not copy, modify, distribute, or create derivative works from any part of the Service, except for the limited personal-use license granted here.
6. Third-party services
The Service integrates with third parties (GitHub for auth and activity data; Anthropic or OpenAI for LLM chat when you provide your own API key; Supabase for hosted data; Vercel for hosting; Upstash for caching; LemonSqueezy or Stripe for payments, when applicable). Your use of those services is subject to their own terms. We are not responsible for outages, data loss, or misuse caused by third-party providers.
7. Payments and subscriptions
Some features (for example, GitMon Plus, cosmetic items, Level 4 Pro analytics) may require payment. If you purchase a paid feature:
- Prices, billing cycles, and renewal terms are shown at the point of purchase.
- Subscriptions renew automatically until you cancel. You can cancel anytime from settings; cancellation takes effect at the end of the current billing period.
- Refunds are offered where required by law (for example, a 7-day right of withdrawal for EU and Brazilian consumers). Otherwise, payments are non-refundable.
- We may change prices with at least 30 days' notice before your next renewal.
- Virtual items (cosmetics, species skins) have no cash value and are not transferable outside the Service.
8. Browser extension
The GitMon browser extension is provided under the same Terms. Installing the extension is optional. You control its privacy level at all times. See the Privacy Policy for what the extension collects at each level.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that any data (including your gitmon's state) will be preserved indefinitely.
GitMon is for entertainment and personal productivity. It is not professional advice of any kind.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) R$ 100 (one hundred Brazilian Reais).
11. Indemnification
You agree to defend and indemnify us against any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your content, or your misuse of the Service.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (IP, disclaimers, liability, governing law) do so.
13. Business transfers
If GitMon is acquired by, merged with, or transfers assets to another entity, these Terms and your account may be part of that transfer. The acquiring entity will be bound by these Terms and the Privacy Policy, or will notify you and obtain consent before applying different terms. You will have the right to export or delete your data before any such transfer takes effect.
14. Changes to these Terms
We may update these Terms. Material changes will be announced via email and a banner in the web app at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and delete your account before the effective date.
15. Governing law
These Terms are governed by the laws of Brazil. Any dispute will be resolved in the courts of São Paulo, Brazil, except where consumer protection law grants you the right to sue in your jurisdiction of residence. Nothing in these Terms limits your statutory consumer rights under LGPD, GDPR, or CCPA.
